TERMS OF SERVICE
The following constitutes our Terms of Service. By utilising this website and our services and making reservations, the client acknowledges and accepts these Terms of Service.
1. Bookings
Please book early. Transportations are always on a first come, first served basis.
2. Prices
Prices are correct at the time of publication. They are, however, subject to change without notice due to fuel, Exchange Rates, Government Taxes and other transport costs as determined by the operator.
3. Changes To Prices
Feriback PLT may without notice change the prices of transportation and services due to external factors, though this is not normally anticipated.
4. Changes by the operator
Further, it is possible that dates may change or even be cancelled by the operator after a booking has been accepted due to circumstances beyond our control. In such cases, we will endeavour to minimise inconvenience to our guests by replacing or substituting a similar product or service in its place.
5. Possible Changes
Operators may change or cancel their empty legs or the service altogether. Should this occur, Feriback PLT will, wherever possible, substitute a suitable arrangement of a similar value.
6. Prices Exclude
Unless stated otherwise, prices quoted do not include cost of passport, visas where required, airport taxes / charges where applicable, items of a personal nature and / or items specified in the itinerary as “optional “
7. Deposit & Payment
Upon verification of your reservation, Feriback PLT will forward our bank account details to you by e-mail for convenient payment. Please remit a booking deposit of USD100 into our account. Upon confirmation of your empty leg or service requested, we will forward our invoice for the full amount for said service. The full amount less USD100 shall be due immediately. Failure to comply with this requirement may result in an automatic cancellation of your reservation and forfeiture of the USD100 booking fee. Also, in cases of cancellation of reservation by client, any charges incurred by Feriback PLT to the operator as a result of such cancellation will be added to the cancellation fee above. We shall acknowledge receipt of your payment and confirm acceptance of your reservation as soon as possible. Feriback PLT is not obliged to accept any reservation and no contract exists until Feriback PLT has received the full payment due and has acknowledged as such.
8. Travel Documents and Visas
Please be advised that it is the client’s responsibility to ensure that their travel documents and necessary visas are in order. Feriback PLT shall not be held responsible or liable for any expenses or losses, if any travellers are refused entry, transit or travel by any government authorities of any country for whatever reasons, including lack of the necessary visas or other travel requirements.
9. Passenger Manifest
Please submit to Feriback PLT a complete name list of passengers when making reservations.
10. Cancellation and Refund Policy
All Cancellations and requests for refund must be in writing. In the event of cancellation of reservation, notice in writing must be received by us no less than 21 days before date of service required. No cancellation is allowed for reservations made less than 21 days of service requested. Feriback PLT shall provide refunds only to the extent that refunds are available to Feriback PLT from the operator. Any charges incurred by Feriback PLT to the operator as a result of such cancellation will be added to the cancellation fee above. You are therefore kindly requested to ensure that everything is in order before transferring your payment to our account.
11. Insurance
We strongly recommend that clients purchase worldwide travel or personal insurance where applicable.
12. Right Of Refusal
a. Feriback PLT reserves the right to cancel or withdraw any services arranged for the client if the client is known to be engaged in any illegal activities during the course of the trip or utilising our products and/or services for any illegal activities. In such cases Feriback PLT reserves the right to withhold and/or terminate further services and cooperation and shall not entertain any claim for any refund or reimbursement.
b. Feriback PLT reserves the right to withhold or cancel any reservation to any person, if for any reason the operator refuses to accept that person as their guest.
c. Feriback PLT reserves the right to require any person to withdraw from utilising any service if it is deemed that his/her action or conduct is offensive to or incompatible with the comfort of other clients and Feriback PLT shall be under no further liability.
d. Without prejudice, Feriback PLT reserves the right to cancel any reservations and shall remit a full refund to the cancelled party subject to the deductions applicable as mentioned under Cancellation and Refund Policy.
13. Responsibility
Feriback PLT and its associated agents act only as agents for the client and the transportation companies. All tickets, vouchers and documents are issued subject to the terms, conditions and contracts of the operator under which such transportation and services are provided. Feriback PLT and its agents and representatives are not responsible and expressly disclaim any liability for any injury, damages, loss, delay, accident or irregularities that may be caused to persons or properties and all bookings are subject to the usual terms, conditions and contract of the operator of the services involved.
14. Transportation companies or firms shall be exempted from all liabilities in respect of any detention, delay, loss, danger, sickness, or injury, however caused and of whatever kind occurring at any time when the passenger is not on board a carrier or conveyance used or operated by the transportation companies or firms.
15. Feriback PLT shall not be held liable for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by events which are beyond its control, or which are not preventable by reasonable diligence on its part including but not limited to war, terrorist activities, civil disturbance, fire, floods, unusually severe weather, acts of god, acts of government or of any authorities, accidents to or failure of machinery or equipment or industrial action.
16. Feriback PLT shall not be responsible for breach of contract or any intentional, unintentional or careless actions or omissions on the part of the operators. Your acceptance of our services and/or products as stated in our brochures, tickets, vouchers and/or booking notes issued shall constitute consent to the above specifically and to these Terms and Conditions generally, as well as an agreement on your part to convey the same to your travel companions and/or group members.
17. The Client, by engaging Feriback PLT and making deposit and/or full payment for the service requested, acknowledges the position of the company as stipulated by these Terms and Conditions and agrees to hold Feriback PLT blameless in making the arrangements on his behalf and further agrees that restitution of damages, if any are claimed, shall be sought directly from the operator. The client also agrees to the terms and conditions of the service as set forth by the operators.
18. Payments made, whether partial or full shall constitute agreement and acceptance of all provisions stated herein.
19. Laws of Malaysia Shall Prevail
Clients making orders to or entering into transactions with Feriback PLT do so with the understanding and acceptance that the Laws of Malaysia shall prevail over such orders or transactions and that Legal Domicile shall always be Kuala Lumpur, Malaysia.
20. Grievances
All complaints and claims against Feriback PLT must be made in writing within 30 days after the completion of the service. All disputes if any, shall be subject to the jurisdiction of the Malaysian Court of Law.
21. Use Of Our Services
The use of this web site, its contents and our services including all orders and reservations made shall constitute agreement and acceptance of these terms and conditions.
